Notice of Proposed Ordinance Council Procedure

NOTICE OF PROPOSED ORDINANCE

YOU ARE HEREBY NOTIFIED that the City of Paynesville is considering the following proposed Ordinance at 6:00 p.m. on May 11, 2020 at their Regular City Council meeting:

ORDINANCE NO. 12, 3RD SERIES

            AN ORDINANCE OF THE CITY OF PAYNESVILLE, MINNESOTA, AMENDING CITY CODE CHAPTER 2 ENTITLED “ADMINISTRATION” AT ARTICLE II THEREOF ENTITLED “CITY COUNCIL”, BY MODIFYING SECTION 2-29 ENTITLED “COUNCIL PROCEDURE AT REGULAR MEETINGS”.

            THE CITY COUNCIL OF PAYNESVILLE, MINNESOTA ORDAINS:

            Section 1.  City Code, Chapter 2, entitled “Administration” at Article II thereof, entitled “City Council”, are hereby amended by modifying Section 2-29 entitled “Council Procedure at Regular Meetings”, to read as follows:

            Section 2-29. – Council Procedure at Regular Meetings.

                        (a)  The Mayor shall preside over all Council meetings unless he or she is unavailable, in which case the Mayor Pro Tem shall preside over the meeting.  The Council shall abide by the following order of business, which may be reviewed and modified from time to time:

                                    (1)  Call to Order;

                                    (2)  Pledge of Allegiance;

                                    (3)  Oath of Office for New Elected Officials, if any;

                                    (4)  Council Member Reports;

                                    (5)  Department Head Reports:

                                                (i) City Administrator;

                                                (ii)  Public Works;

                                                (iii) Police Chief, Fire Chief and Liquor Store:  The Police Chief, and Liquor Store Manager shall present their report(s) to the Council at least once every two (2) months on a rotating schedule.

                                    (6)  Consent Agenda;

                                    (7)  New Business;

                                    (8)  Old Business; and

                                    (9)  Any other special hearings needing to be discussed by the Council.

                        (b)  The City Administrator, in coordination with other staff as necessary or desired, shall prepare the following items in advance of a regularly scheduled meeting:

                                    (1)  An agenda pursuant to the following provisions:

                                                (i)  All items submitted for inclusion on the agenda, including but not limited to claims for payment, for the next regularly scheduled meeting of the Council shall be submitted to City Hall no later than 10:30 a.m. on the Tuesday preceding the regularly scheduled meeting.

                                                (ii)  Items submitted by a City department head, the City Administrator, a current Councilmember, or the current Mayor by no later than 10:30 a.m. on the Tuesday preceding the regularly scheduled meeting, shall be included in the upcoming agenda.

                                                (iii)  Community individuals may submit materials included in the agenda and reviewed by the City Council, and may make a request to address the City Council.  A community individual wishing to address the Council or submit materials to be reviewed, must submit a written request to City Hall no later than 10:30 a.m. on the Tuesday preceding the regularly scheduled meeting.  The City Administrator shall have discretion as to whether to include such items in the upcoming agenda, unless the submission is also proffered by a sitting Councilmember or the current Mayor, in which case it shall be included on the agenda.

                                    (2)  A compiled list of all claimants who have verified accounts claiming payment for goods or services rendered to the City during the preceding month, such list to be called the “claim report” and bearing headings for claimant, purpose and amount;

                                    (3)  A copy of all Minutes to be considered; and

                                    (4)  Copies of such other proposals, communications, or other documents the City Administrator deems necessary or proper for advance consideration by the Council.

                        (c)  The City Administrator shall forthwith cause to be mailed, e-mailed, or otherwise delivered to each member of the Council, copies of the agenda and all supporting documents by the close of business on the Thursday preceding the upcoming Council meeting.

                        (d)  Matters inappropriate for consideration at a meeting shall not be considered, except with the unanimous consent of the members of the Council or scheduled public hearings or bid lettings at the time stated in the notice.

            Section 2This Ordinance shall take effect and be in force upon its passage, adoption and publication. 

            A copy of said Ordinance is available for review by any person during regular City Hall office hours (8:30 a.m. to 4:30 p.m. Monday – Friday).
