Notice of Proposed Ordinance Assessment for Senior Citizens/Cable Board/Protection of Trails

NOTICE OF PROPOSED ORDINANCE

YOU ARE HEREBY NOTIFIED that the City of Paynesville is considering the following proposed Ordinance at 6:00 p.m. on February 10, 2020 at their Regular City Council meeting:

ORDINANCE NO. 9, 3RD SERIES

            AN ORDINANCE OF THE CITY OF PAYNESVILLE, MINNESOTA, AMENDING CITY CODE CHAPTER 26 ENTITLED “SPECIAL ASSESSMENTS” AT SUBDIVISION 26-7 THEREOF, ENTITLED “GENERAL ASSESSMENT POLICIES”, SUBPART (i), ENTITLED “DEFERMENT OF SPECIAL ASSESSMENTS FOR SENIOR CITIZENS”; AND SPECIFICALLY SUBPART (2) THEREOF, ENTITLED “INTEREST ON DEFERRED ASSESSMENTS”; AND BY ADOPTING BY REFERENCE CITY CODE CHAPTER 1 ENTITLED “GENERAL PROVISIONS FOR ORDINANCE VIOLATIONS”, WHICH, AMONG OTHER THINGS, CONTAIN PENALTY PROVISIONS FOR ORDINANCE VIOLATIONS.

            THE CITY COUNCIL OF PAYNESVILLE, MINNESOTA ORDAINS:

            Section 1.  City Code, Chapter 26, entitled “Special Assessments”, at Section 26-7 thereof entitled General Assessment Policies, and (i) thereunder entitled Deferred Assessments for Senior Citizens, and Subpart 2 thereunder, entitled “Interest on Deferred Assessments”, is hereby amended to read as follows:

                        (2)  Interest on Deferred Assessments.  Deferred special assessments shall not be subject to, and shall not be charged interest, during the period of deferment, and no interest shall accrue during the period of deferment.  Commencing 60 days following the termination of the deferral status, interest shall accrue at a rate equivalent to the interest rate set for the original improvement project assessment roll.  Interest shall accrue until the assessment is satisfied, or as set by the City Council.  This policy is retroactive to deferred assessments under prior improvement projects.

            Section 2City Code, Chapter 1, entitled “General Provisions”, including penalties for violation, are hereby adopted by reference as though repeated verbatim herein.

            Section 3.  This Ordinance shall take effect and be in force upon its passage, adoption and publication.

        A copy of said Ordinance is available for review by any person during regular City Hall office hours (8:30 a.m. to 4:30 p.m. Monday – Friday).

ORDINANCE NO. 8, 3RD SERIES

            AN ORDINANCE OF THE CITY OF PAYNESVILLE, MINNESOTA, AMENDING CITY CODE CHAPTER 2, ENTITLED “ADMINISTRATION; AND ARTICLE V THEREOF, ENTITLED “BOARDS & SIMILAR BODIES”, BY DELETING SECTION 2.182 THEREOF, ENTITLED “CABLE BOARD”.

            THE CITY COUNCIL OF PAYNESVILLE, MINNESOTA ORDAINS:

            Section 1.  City Code, Chapter 2, entitled Administration, and Article V thereof, entitled Boards & Similar Bodies, is hereby amended as follows:

            City Code, Chapter 2, Article 4, Section 2.182, entitled “Cable Board” is hereby deleted.

            Section 2.  This Ordinance shall take effect and be in force upon its passage, adoption and publication.

        A copy of said Ordinance is available for review by any person during regular City Hall office hours (8:30 a.m. to 4:30 p.m. Monday – Friday).

ORDINANCE NO. 7, 3RD SERIES

            AN ORDINANCE OF THE CITY OF PAYNESVILLE, MINNESOTA, AMENDING CITY CODE CHAPTER 22 ENTITLED “PARKS AND RECREATION”, AT SECTION 22-26 ENTITLED “TRAIL USES” AND AT SECTION 22-29 ENTITLED “PROTECTION OF TRAILS”; AND ADOPTING BY REFERENCE CITY CODE CHAPTER 1 ENTITLED GENERAL PROVISIONS, WHICH, AMONG OTHER THINGS, CONTAIN PENALTY PROVISIONS FOR ORDINANCE VIOLATIONS.

            THE CITY COUNCIL OF PAYNESVILLE, MINNESOTA ORDAINS:

            Section 1.  City Code, Chapter 22, Section 22-26 is hereby amended to add Subpart (g) to read as follows:

            Section 22-26.  Trail Uses.

                        (g)  Other Allowed Non-Motorized Uses.  In addition to bicycles, it shall be permissible to use rollerblades, strollers, wheelchairs, or other non-motorized wheeled conveyances on the pedestrian trail.  All such wheeled conveyances shall be operated as close to the right-hand side of the pedestrian trail as possible, and shall be operated with an appropriate light at night, meeting the requirements for bicycle lighting equipment set forth herein above.  Non-motorized wheeled conveyances shall not exceed 40” in width.

            Section 2.  City Code Chapter 22, Section 22-29, entitled Protection of Trails, is hereby amended to add Subparts (e), (f) and (g), to read as follows:

                        (e)  Alcoholic Beverages.  No person shall serve, possess or consume any alcoholic beverage or beer on a pedestrian trail.

                        (f)  Pets.  No person shall bring or allow a pet on a pedestrian trail, except on a leash not to exceed eight (8) feet in length.

                        (g) Private Property.  No person shall leave a pedestrian trail and enter onto private property without permission of the land owner.

            Section 3.  City Code, Chapter 1, entitled General Provisions, containing, among other things, penalty provisions, is hereby adopted by reference as though repeated verbatim herein.

            Section 4.  This Ordinance will take effect and be in force upon its passage, adoption and publication.
