Notice of Proposed Ordinance Consumption of Alcohol in Public Places

NOTICE OF PROPOSED ORDINANCE
YOU ARE HEREBY NOTIFIED that the City of Paynesville City Council is considering the following proposed Ordinance at 6:00 p.m. on December 13, 2021 at their Regular City Council meeting:
ORDINANCE NO. 30, 3RD SERIES

            AN ORDINANCE OF THE CITY OF PAYNESVILLE, MINNESOTA, AMENDING CITY CODE CHAPTER 4 ENTITLED “ALCOHOLIC BEVERAGES”, AND SECTION 4-5 THEREOF ENTITLED “CONSUMPTION IN PUBLIC PLACES” AND BY ADOPTING BY REFERENCE CITY CODE CHAPTER 1 SECTION 11.99 WHICH, AMONG OTHER THINGS, CONTAINS PENALTY PROVISIONS.

            THE CITY COUNCIL OF PAYNESVILLE, MINNESOTA ORDAINS:

            Section 1.  City Code, Chapter 4 entitled “Alcoholic Beverages” and Section 4-5 thereof entitled “Consumption in Public Places” is hereby amended to read as follows:

            Section 4-5.  Consumption in Public Places. No person shall consume intoxicating liquor or 3.2 percent malt liquor in any public park, on any public street, sidewalk, or parking lot or alley, or any public place, or any private parking lot to which the public has access, except where specifically allowed by permit from the City with rental of park facilities, within the fire department or on the premises and within the area of the establishment licensed under this Chapter, in a municipal liquor dispensary if one exists in the City, or where the consumption and display of liquor is lawfully permitted, and such consumption and display complies with that permit including, but not limited to, geographic limits contained therein.

            Section 2.   City Code, Chapter 1, entitled “General Provisions”, and Section 1-11 entitled “Violation, a Misdemeanor Unless Otherwise Stated” are hereby adopted in their entirety by reference as though repeated verbatim herein.

            Section 3.   This ordinance will take effect and be in force upon its passage, adoption and publication.
